Terms of service

The agreement between us when you shop at fetchandfold.com.au. These are written in formal language by necessity - it's how terms have to be written to mean what they need to mean. If anything's unclear, email support@fetchandfold.com.au and we'll talk you through it.

1. Who we are

"Fetch & Fold," "we," "us," and "our" refer to Fetch & Fold, an online pet store based in Brisbane, Queensland, Australia. Our store operates at fetchandfold.com.au and is powered by Shopify. Together, the website, our products, and all related services are referred to as the "Services."

These Terms of Service ("Terms") set out the agreement between you and Fetch & Fold whenever you use our Services. By visiting, browsing, or purchasing from our store, you agree to be bound by these Terms and by our Privacy Policy. If you don't agree, please don't use our Services.

2. Eligibility and your account

By using our Services, you confirm that you are at least the age of majority in your state or territory, and that any minor in your household uses our Services only with your supervision and consent.

If you create an account with us, you're responsible for keeping your login details secure and for all activity on your account. You can't transfer your account to anyone else. The information you give us (name, email, address, payment details) must be accurate and up to date.

3. Our products

We do our best to show our products accurately, but colours and finishes may look slightly different on your screen depending on your device. We don't guarantee that the appearance of a product will exactly match what you see online - though we will always describe products as accurately as we can.

We may update, discontinue, or limit availability of any product at any time, and may limit the quantity available to any person or region at our discretion.

4. Orders, pricing and payment

When you place an order, you're making an offer to buy. We accept your order when we confirm it and process your payment. Until that happens, we may decline or cancel any order for any reason.

Prices, discounts, and promotions are subject to change without notice. The price you'll pay is the price shown at the time of checkout, and will be confirmed in your order confirmation email. Unless we say otherwise, prices include shipping but exclude any applicable taxes or duties.

You confirm that the payment information you provide is accurate, that you're authorised to use the payment method, and that you'll pay any charges you incur.

We reserve the right to correct typographical errors, pricing errors, or other inaccuracies - including after you've submitted your order. If we need to cancel or adjust your order for this reason, we'll contact you using the details you provided.

5. Shipping and delivery

All shipping is governed by our Shipping Policy. Delivery times are estimates, not guarantees. We're not liable for delays caused by shipping carriers, customs, or events outside our control. Once your order is handed to the carrier, the risk of loss passes to you, although we'll work with you to resolve any issues that arise.

6. Returns and refunds

Returns and refunds are governed by our Refund Policy. Your purchases are for personal or household use only, not for commercial resale.

7. Intellectual property

Everything on our Services - the brand, logo, product names, photography, text, design, and arrangement of content - is owned by Fetch & Fold or our licensors and protected by Australian and international copyright and trademark laws. You may browse, share, and personally use what we publish, but you can't copy, reproduce, modify, sell, or republish any of it without our written permission.

Other trademarks shown on the Services (including Shopify's) belong to their respective owners.

8. Acceptable use

You agree to use our Services only for lawful, personal purposes. Specifically, you agree not to:

Use the Services for any unlawful, fraudulent, or harmful purpose
Infringe the intellectual property or rights of others
Harass, abuse, or harm any person, including our team
Submit false or misleading information
Send spam or unsolicited promotional content
Impersonate any other person or entity
Upload viruses or malicious code
Scrape, copy, or extract any portion of our Services without permission
Use automated tools, bots, or AI agents to access the Services without our consent
Interfere with or attempt to circumvent the security features of our Services

If you breach any of these rules, we may suspend or terminate your access without notice.

Our Services may include or link to third-party tools, content, or websites. We don't control them, don't endorse them, and aren't responsible for their content or practices. If you use them, you do so at your own risk and subject to the third party's own terms.

10. Relationship with Shopify

Fetch & Fold is powered by Shopify, which enables us to provide our Services. However, your purchase is made directly with us - not with Shopify. Shopify is not responsible for any aspect of the sale, including the quality of products or any loss or damage that may result. You release Shopify and its affiliates from any claims arising out of your transactions with Fetch & Fold.

11. Your feedback

If you send us feedback, ideas, reviews, or suggestions ("Feedback"), you grant us the right to use that Feedback freely - to improve our Services, market our brand, or for any other lawful purpose - without any obligation to you. You confirm you have the right to share whatever Feedback you submit.

12. Disclaimers

Our Services and the products we sell are provided "as is" and "as available." Other than what's expressly stated in these Terms, we make no warranties, express or implied, about the operation of our Services or the products we sell - including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Nothing in these Terms limits your statutory rights under the Australian Consumer Law, which cannot be excluded or modified. You are entitled to a replacement, refund, or repair for a major failure, and to compensation for any other reasonably foreseeable loss or damage.

13. Limitation of liability

To the maximum extent permitted by law, Fetch & Fold, our team, our partners, and Shopify will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Services or any product you purchase from us - including lost profits, lost data, or replacement costs.

Nothing in this section limits your statutory rights under the Australian Consumer Law.

14. Indemnification

You agree to indemnify and hold harmless Fetch & Fold, Shopify, and our respective teams from any claims, losses, or damages (including reasonable legal fees) arising from your breach of these Terms, your violation of any law or third-party right, or your use of our Services.

15. Governing law

These Terms are governed by the laws of Queensland, Australia and the Commonwealth of Australia. Any disputes will be resolved in the courts of Queensland.

16. Changes to these Terms

We may update these Terms at any time. The most current version is always available on this page. If we make significant changes, we'll do our best to notify you. Your continued use of our Services after changes take effect means you accept the updated Terms.

17. General

If any part of these Terms is found to be unenforceable, the rest still applies. Our failure to enforce any provision doesn't waive our right to do so later. These Terms (along with our policies) form the entire agreement between you and us regarding our Services.

You can't transfer your obligations under these Terms to anyone else without our consent. We may transfer ours.
